In this course we will address, in a first session, the voice in multiple perspectives. First and foremost, as a right of personality. Timely recognised by the laws, by part of the Portuguese and Spanish doctrine and by some jurisprudential doctrine, it is a right that protects against recordings and uses (commercial or not) of the voice without consent. Secondly, we will study voice as personal data, which will have an impact on the biometric voice recognition techniques already used by many products and services in the virtual environment. We will analyse the European regulations and the Spanish and Portuguese laws, which until now have not solved all the problems arising from the use of these techniques.
In a second session, we will deepen the understanding of voice as a characteristic that individualises us as persons. Possible gender biases of virtual voice assistant technologies such as Siri, Alexa or Cortana will be discussed. The course will end with an overview of the various personality rights (image, honour, intimacy) where gender issues still persist (in most legal systems around us) and which should gradually be brought to light.
