The ‘Programmed Obsolescence’ of Labor Law: Digital platforms, algorithms and artificial intelligence systems

Abstract

The Digital Revolution has triggered the need to rethink traditional Labor Law. The obvious inability of this branch of the law to produce adequate responses to the new challenges resulting from the massification of the work on digital platforms, the gradual transfer of decision-making to algorithms and other artificial intelligence systems, as well as the robotisation of countless complex tasks, has led to the adoption of a series of legislative measures, both at national and european level. However, even though the first steps have been taken, in our opinion these measures are still insufficient to protect workers' interests. Therefore, this study aims to promote a reflective analysis of the most pressing issues of this new labour situation with the aim of contributing to the doctrinal debate on the challenges facing the legislator.
